General Terms and Conditions for

Scope of Application, Definitions I.I Air Service Berlin CFH GmbH, registered in the Charlottenburg Commercial Register under number HRB 73125 (hereinafter referred to as “ASB”), offers round-trip tickets (hereinafter “Tickets”) and value vouchers (hereinafter “Vouchers”) and similar services for sale on its website www.berlinhelicopter.de. Vouchers are generally sold without a fixed date – after the purchase of the vouchers, the redemption is also carried out via the website, for example, on a specific date. Contractual partners (hereinafter referred to as “Customers”) may be both consumers and entrepreneurs. I.II A consumer in the sense of these General Terms and Conditions is any natural person who enters into a legal transaction for a purpose that can be attributed neither to his commercial nor to his independent professional activity. I.III Entrepreneur in the sense of these General Terms and Conditions is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his independent professional or commercial activity. I.IV Participant of a sightseeing flight (hereinafter referred to as “Participant”) can be both the customer himself and the authorized holder of a voucher. I.V These General Business Relationships shall apply to all contracts and appointment agreements that a customer or voucher holder concludes with ASB with regard to the vouchers and/or events presented on the website at www.air-service- berlin.de. In addition, they apply to contracts that take place without the inclusion of the website www.air-service-berlin.de. The inclusion of the customer’s own conditions is hereby objected to, unless otherwise agreed. Section II. Conclusion of Contract II.I The articles and/or events described on the website of ASB do not represent binding offers on the part of ASB, but serve for the submission of a binding offer by the customer. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order. II.II When ordering tickets and/or vouchers, the customer can submit the offer via the online order form provided on the website. After selecting a ticket and/or voucher with the desired event and/or the desired amount, the customer submits a legally binding contractual offer with regard to the selected item by clicking the button that concludes the ordering process. Furthermore, the customer can also submit his offer by telephone, fax, e-mail or mail. By submitting the offer, the General Terms and Conditions shall be deemed to have been accepted. II.III ASB can accept the offer of the customer within five days by sending the customer a written order confirmation (fax, e-mail, postal), in which case the receipt of the order confirmation by the customer is decisive, or by requesting the customer to make payment after the customer has placed his order. II.IV The period for the acceptance of the offer begins on the day after the sending of the offer by the customer and ends with the expiry of the fifth day following the sending of the offer. II.V When an offer is made via ASB’s online order form, the text of the contract shall be saved by the organizer and sent to the customer in text form (e.g. e-mail, fax or letter) after the order has been saved together with these General Terms and Conditions. II.VI Order processing and contacting usually take place by e-mail and automated order processing. The customer must ensure that the information provided by him for order processing, in particular the e-mail address, is correct so that e-mails sent by ASB can be received at this address. In particular, when using SPAM filters, the customer must ensure that all e-mails sent by ASB or by third parties commissioned by ASB with the order processing can be delivered. II.VII A distinction is made between tickets and value vouchers. Tickets are offered for specific sightseeing flights with a clear description and a specific purchase price. Value vouchers, on the other hand, only have a value in euros and do not include a specific service. However, value vouchers can be used to pay for a specific sightseeing flight in the shopping cart. If the value of the purchased voucher is less than the redeemed value of the voucher, the remaining amount can be redeemed later (within the limitation period) with another offer. II.VIII A voucher of value is a means of payment exchange. Therefore, the receipts do not show the value added tax. II.IX If the purchaser is a minor, the conclusion of the contract between the organizer and the minor customer requires the consent or approval of the minor’s legal representative. In this case, ASB reserves the right to make the conclusion of the contract dependent on the proof of a corresponding consent or approval. II.X Tickets and/or vouchers that have not been purchased directly from ASB but through an intermediary are valid if the intermediation has been successfully completed. This is the case when the customer has received the valid voucher and the corresponding purchase amount has been received by ASB. Section III. general provisions III.I Tickets and/or vouchers will be issued only after the payment has been received by ASB. III.II Up to 3 calendar days before the start of the event, all booking-relevant data (full name, address, telephone number, weight and date of birth) and any notifications of special circumstances, such as physical infirmities, must be communicated by telephone. Should the passenger be prevented from arriving on the agreed flight date, he/she must also notify us of this no later than three calendar days before the flight date or provide a suitable substitute person to be named in advance by telephone. If a change of passenger occurs on the day of the event at check-in or if the data required in paragraph 1 of this section must be added, a rebooking fee of €20.00 per ticket will be charged. In case of no-show, the ticket will be forfeited without replacement. The Commander Frank ticket hotline (030) 5321 5321 can be reached from Mon-Fri 9-17 hrs. III.III ASB is only obliged to perform the flight if the agreed fee has been received by ASB prior to the flight. The fee is due upon receipt of the invoice. In the case of charter contracts in accordance with the terms of payment listed therein. In the event of a delay in payment, ASB is entitled to demand a processing fee of € 5.00 per reminder and to charge interest on the amount at a rate of 4.12 % above the statutory base interest rate. III.IV The carriage of passengers in aircraft is subject to the Montreal Convention. According to the international regulations for aviation, the liability of the Carrier for personal injury and property damage is limited to the sums specified therein. The provisions of the Montreal Convention shall prevail in case of doubt. In addition, German law shall apply. Claims for damages with regard to futile travel costs, return transport costs or loss of earnings are excluded. This does not apply if ASB can be accused of intent or gross negligence. In all other respects ASB shall only be liable in the event of intent or gross negligence. III.V The carriage of luggage is excluded unless otherwise stated in these GTC. Baggage must not contain the following articles and substances: flammable liquid substances as well as paint and thinner also lighter fluid, flammable solid and other easily flammable materials and substances that tend to spontaneously combust, substances that are flammable or emit toxic gases in contact with water, oxidizing substances (such as bleaching powders and peroxides), toxic (poisonous) substances and pathogens (bacteria and viruses), radioactive materials corrosives such as acids, alkaline batteries and mercury magnetizing substances and other dangerous goods listed in the IATA Dangerous Goods Regulations. Medicines and medical equipment are exempt from the above regulations, provided that there is no risk to flight safety. The carriage of animals is excluded, unless this special request has been expressly agreed in the flight confirmation. The pilot in command has the right to exclude from the flight, before take-off, individual passengers who are under the influence of alcohol or drugs or whose behavior endangers the safety of the event. In this case, a refund of the flight price is excluded. III.VI We offer a wheelchair service. Our partner is the company AAS Aviation & Airport Services, the cost is 100,00 € per half hour or part thereof. These additional costs are to be paid by the passenger. Section IV. Prices and terms of payment IV.I The indicated prices are final prices and include the legal sales tax. Each buyer receives an invoice with VAT by email when a ticket is purchased
